1) Scope
This Notice describes how we collect, use, disclose, and protect personal information when you visit our sites, purchase or use our software/scripts/indicators/tools (the “Software”), contact support, or otherwise interact with us. It supplements any product-specific terms (e.g., Terms, Subscriber Certifications, Risk Disclosure).
2) Information We Collect
Account & Contact: name, email, username/IDs, billing and subscription details.
Transaction: purchase history, last four digits/brand/expiry (payments are processed by third parties; we do not store complete card numbers).
Technical & Device: IP address, device identifiers, browser type/version, OS, time zone, language, referrer/UTM, error logs.
Usage & Telemetry: feature usage, timestamps, performance metrics, crash reports, license verification, device/account binding, rate-limit and anti-abuse signals, and watermark identifiers embedded in outputs.
Communications: emails, tickets, chat messages, and feedback.
Platform Data: limited info from platforms where Software runs (e.g., TradingView account ID) to enable access and licensing.
Cookies & Similar: site analytics, session management, and preference cookies (see “Cookies” below).
Sources: you, your devices, payment providers, distribution platforms, and service providers who act on our behalf.
3) How We Use Information
Provide, activate, and support the Software; process orders and renewals.
Enforce licenses, prevent fraud/abuse
Analyze performance and improve features.
Communicate about service updates, security, and account matters; send optional marketing.
Comply with law, defend legal claims, and protect rights, users, and systems.
4) Sharing & Disclosures
We do not sell personal information and do not share it for cross-context behavioral advertising. We disclose to:
Processors/Service Providers: hosting/CDN, analytics, error logging, email/support, payment and license management—bound by contract to use data only for our instructions.
Platforms & Integrations: to enable features and licensing (e.g., account entitlements).
Legal/Compliance: to comply with law, enforce terms, or respond to lawful requests.
Business Transfers: in M&A, financing, or asset transfers (subject to this Notice or equivalent protections). We may publish aggregated or de-identified statistics that do not identify individuals.
5) Cookies & Similar Technologies
We use essential cookies for security, session, and licensing; and (optionally) analytics cookies to understand site usage. You can control cookies via browser settings. If required in your region, we will present a consent banner for non-essential cookies.
6) Data Retention
We retain personal information only as long as needed for the purposes above, including contract duration, legal requirements (e.g., tax/audit), security, and dispute resolution. We then delete or de-identify it.
7) Security
We use administrative, technical, and organizational measures appropriate to the risk (e.g., encryption in transit, access controls, logging). No system is perfectly secure; you use the Software at your own risk.
8) Your Choices
Marketing: unsubscribe via email or by contacting us.
Cookies: manage via your browser and our consent banner.
Account: request updates or deletion by contacting support.
9) Your Privacy Rights
Depending on where you live, you may have rights to access, correct, delete, port, restrict or object to certain processing, and to withdraw consent where processing is based on consent.
How to exercise: email support@evergreensolutions.one with your request and sufficient information to verify your identity. We will respond within the time required by applicable law. You won’t be discriminated against for exercising rights.
California (CPRA) Notice of Collection
Categories collected: identifiers (e.g., name, email, IP), commercial info (purchases), internet/network activity (usage/telemetry), inferences (feature adoption), and limited account data from platforms.
Purposes: those listed in Section 3.
Disclosures: to service providers and processors as described in Section 4.
Sales/Sharing: We do not sell or share personal information as defined by CPRA.
Sensitive data: not collected for the purpose of inferring characteristics; used only for security and operations if present.
10) International Data Transfers
If you are outside the United States, your data may be processed in the US and other countries. Where required (e.g., EU/UK), we rely on appropriate safeguards such as Standard Contractual Clauses for transfers.
11) Children’s Privacy
Our services are not directed to children under 18. We do not knowingly collect their data. If you believe a child provided data, contact us and we will delete it.
12) Changes to this Notice
We may update this Notice from time to time. We will post the updated version with a new Effective Date and, where required, notify you. Continued use after changes means you accept the updated Notice.
