Markets can move rapidly due to news and other events. Data may be delayed, inaccurate, or interrupted. Orders may be rejected, partially filled, or filled at worse prices. Connectivity, brokerage, exchange, API, and platform outages can occur. You are solely responsible for monitoring, trade authorization, and risk controls. 

Regulatory Status

Unless explicitly stated otherwise in writing, the publisher/developer is not acting as a broker, dealer, investment adviser, CTA, CPO, or fiduciary, and is not registered with the SEC, CFTC, NFA, or any other regulator. 

User Responsibilities 

You agree to perform your own due diligence; to consult qualified professionals regarding financial matters; and to implement independent risk limits, position sizing, and kill-switch procedures.

The software and all outputs are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. 

Limitation of Liability

To the maximum extent permitted by law, in no event shall the publisher/developer be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, trading losses, loss of data, or business interruption, arising from or related to the use of the software, even if advised of the possibility of such damages. Aggregate liability, if any, shall not exceed the greater of (a) the fees you paid specifically for this software in the twelve (12) months preceding the claim, or (b) one hundred (100) U.S. dollars. 

Indemnification

You agree to defend, indemnify, and hold harmless the publisher/developer and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the software, your trading decisions, or your violation of these terms. 

Assumption of Risk & Acknowledgment

By using the software, you acknowledge that you understand the risks of speculative trading and accept full responsibility for all results, decisions, and outcomes.
